High Court orders retrial of former rugby players in rape case

The High Court has today ordered a retrial of rugby players Frank Wanyama ans Alex Olaba who were convicted for raping a young woman in 2018. The two who were convicted on August 16th 2019 were sentenced to 15 years in prison after a highly emotive trial. It has emerged that the case will now be heard afresh at a lower court even as the High Court directs the two be taken to Kilimani Police Station to prepare for a plea taking before July 7th.

Section 10 of the Sexual Offences Act stipulates that any person found guilty of gang rape is liable upon conviction to imprisonment for a term of not less than 15 years. The two former rugby players were found to be guilty after the complainant, aged 24 at the time, said that she had attended a party in Kilimani where the two were present. She further went on to claim that she went home with the two rugby players since she knew one of them.

She alleges that it was after she went home with them that they took advantage of her inebriated state and gang raped her severally refusing to hear her pleas to stop. The two however maintained that the sex was consensual.
