DPP approves the arrest and prosecution of former KPA boss.

DPP Nordin Haji has approved the arrest and prosecution of former Kenya Ports Authority Managing Director Daniel Manduku over irregular procurement of works at the said port. In a statement released on Thursday, Haji revealed that he had established that Manduku authorized and approved the procurement of the manufacture of concrete barriers at the Inland Container Depot, Kilindini Port and Makongeni Goods shed without an approved budget and procurement plan for the 2018/19 financial year.

Haji also intimated that there was no requisition made for concrete barriers by the user department within the KPA as required under procurement laws. It also emerged that there was no prior planning before engaging in the project for the manufacture of the concrete barriers.

The DPP also raised questions with the procurement of the concrete barriers which was commenced through preperation of BOQ as opposed to an open tender in contravention with procurement laws. It was also established that Manduku handpicked 10 companies which were subsequently awarded the contracts to manufacture the concrete barriers. The KPA then proceeded to make an overpayment of Ksh 244 million to the contractors for works not completed. The payment was approved by a Works officer at the Authority named Juma Chigulu.

Manduku and Juma are expected to be arraigned in court.
